Terms of Service

Welcome to SeekerPaint. By downloading, installing, or using the SeekerPaint mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By using SeekerPaint, you confirm that you are at least 18 years old (or have parental consent if between 13–17), that you have the legal capacity to enter into these Terms, and that you agree to comply with all applicable laws and regulations.

2. Description of Service

SeekerPaint is a mobile application for the Solana Mobile Seeker device that allows users to:

• Create digital paintings using a touch-based canvas interface
• Mint paintings as compressed NFTs (cNFTs) on the Solana blockchain
• Pay for minting using USDC or SKR tokens
• View and manage their NFT collection
• Track painting streaks and profile statistics

3. Wallet and Blockchain Transactions

SeekerPaint integrates with the Solana Mobile Seed Vault for wallet connectivity. You are solely responsible for:

• Maintaining the security of your Seeker device and Seed Vault
• All transactions initiated from your wallet through the App
• Ensuring you have sufficient USDC or SKR tokens for minting
• Understanding that all blockchain transactions are irreversible

We have no ability to reverse, cancel, or refund blockchain transactions once confirmed. Minting fees paid in USDC or SKR are non-refundable.

4. NFT Ownership and Intellectual Property

When you mint a painting as an NFT through SeekerPaint:

• You retain full ownership of the NFT and the underlying artwork you created
• You grant SeekerPaint a limited, non-exclusive license to store and display your artwork image for NFT metadata purposes
• You represent and warrant that you own or have the rights to all content you paint and mint
• You are solely responsible for ensuring your artwork does not infringe on third-party intellectual property rights

SeekerPaint does not claim ownership of any artwork you create. The SeekerPaint name, logo, and application code are owned by us and may not be used without permission.

5. Prohibited Content

You agree not to create, upload, or mint content that:

• Infringes on any third party's intellectual property, privacy, or publicity rights
• Contains sexually explicit, obscene, or pornographic material
• Promotes violence, hatred, or discrimination against any group
• Violates any applicable local, state, national, or international law
• Contains malicious code or attempts to compromise the App or blockchain infrastructure

We reserve the right to remove content from our servers that violates these Terms, though we cannot remove on-chain NFT records.

6. Payment Terms

Minting fees are as follows:

• Paint (canvas only): 1 USDC or 50 SKR
• Mixed Media (canvas + photo): 3 USDC or 150 SKR

All payments are processed on-chain via Solana smart contracts. Token prices may be subject to change with notice. Gas fees for Solana transactions are minimal and covered within the minting fee structure. All sales are final.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

We make no representations about the future value of any NFTs minted through SeekerPaint. NFTs are digital collectibles and not financial instruments or investments.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SEEKERPAINT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF TOKENS, NFTs, OR DIGITAL ASSETS, ARISING FROM YOUR USE OF THE APP OR ANY BLOCKCHAIN TRANSACTIONS.

Our total liability to you for any claims arising from these Terms or the App shall not exceed the total fees you paid to us in the 30 days preceding the claim.

9. Blockchain Risks

You acknowledge and accept the inherent risks of blockchain technology, including:

• Solana network congestion or downtime affecting transaction processing
• Smart contract vulnerabilities beyond our control
• Loss of access to your wallet due to device loss or Seed Vault issues
• Regulatory changes affecting NFTs or cryptocurrency in your jurisdiction
• Market volatility affecting the value of USDC, SKR, or NFTs

10. Modifications to the App and Terms

We reserve the right to modify the App, its features, and pricing at any time. We also reserve the right to update these Terms at any time. Continued use of the App after changes constitutes acceptance. We will update the "Last updated" date above when changes are made.

11. Termination

We may suspend or terminate your access to the App if you violate these Terms or engage in fraudulent, abusive, or illegal activity. Termination does not affect your ownership of any NFTs already minted on the blockchain.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration rather than in court, except where prohibited by law.
